Terms and Conditions
THE ESTIMATE: Please review your estimate carefully. It is our best possible cost approximation based on the information you provided. Exact component quantities will be determined during design and will be reflected in the final bill. Everything affecting your total, excluding taxes, duties, etc., should be a line item on the estimate. If you have any questions, please contact us immediately.
EXCLUSIONS: Installation; wood/composite top rail; glass or other infill panels; items not explicitly shown on the estimate.
COMPLETING THE ORDER: A signed estimate and order form, and a 50% deposit are required.
FINAL PAYMENT: Final balance is due upon notification of completion, and prior to shipping. Orders not shipped within 7 days of notification due to an outstanding balance are subject, to a storage fee of $95/day.
FORMS OF PAYMENT: VISA, MC, Discover, wire transfer, ACH or check (projects whose balances are paid by check will ship once check has cleared). Payments of $10,000 or more must be made by ACH, check or wire transfer. ACH and checks require a 10 business-day hold prior to shipping. Please contact us for bank information. AGS will not split payments.
CANCELLATIONS: Upon issuance of any Basis of Design Drawings (BoDD), all deposits and payments received by AGS become non-refundable, and cancellation will result in forfeiture of all monies paid. For purposes of this Agreement, BoDD shall include any drawing submittals issued by AGS for customer review or approval, including but not limited to, Dimension Request, Dimension Verification, Post Approval, and Final Approval Drawings.
Except as noted in ‘SCHEDULE’, orders canceled prior to issuance of BoDD will incur a cancellation fee equal to $500 or 10% of the total contract amount, whichever is greater. Any design, drafting, engineering, project management, or other work performed prior to cancellation will be billed at $140/hr. and deducted from any refund due.
Any expedite fees, special-order materials, or other items procured for the project, are non-refundable and will be forfeited in their entirety. These costs are in addition to, and shall not be credited toward, any applicable cancellation fees.
If a refund is issued for a payment originally made by credit card, AGS reserves the right to deduct any non-refundable credit card processing fees retained by the payment processor.
SCHEDULE: Good communication is crucial to meeting the lead time you discussed with your estimator. Failure to respond to requests for dimensions, photos, etc., in a timely manner could result in delays. Projects that have not moved to Fabrication within 12 weeks will be subject to a new schedule, and will result in forfeiture of the Deposit in the case of cancellation.
DISPUTE RESOLUTION: If a party to this Agreement has reasonable grounds to believe that the other party has failed to fulfill any obligation hereunder, such party will, promptly notify the other party, in writing, of the substance of its belief. The party receiving such notice must respond, in writing, within thirty (30) days of receipt of such notice, and either provide evidence of the dispute specified having been resolved, or provide an explanation of why it believes that its performance is in accordance with the terms of this Agreement. If the parties cannot, in good faith discussions, resolve their dispute within fourteen (14) days of the response, they will be free to pursue all remedies allowed under the law without prejudice.
CUTTER AND CRIMPER USAGE:
RENT: A fully refundable deposit of $350 for 1/8″ cable tools, and $500 for the 3/16″ cable tools will be taken for all tool rentals. Refund is conditional on tools being returned in good condition within 30 days of receiving them. Please allow 10-14 days for refunds to be issued. LATE TOOL RETURNS: $7.50 will be deducted from the deposit for each day past due.
NO TOOLS: Not recommended. AGS cannot guarantee the compatibility of non-AGS crimpers with the CLEARVIEW® Railing System and voids the warranty coverage for the cable assemblies.
MAINTENANCE AND HARSH ENVIRONMENTS: Stainless steel is an alloy whose chemistry makes it highly corrosion-resistant. However, it is not corrosion-proof. In environments where notable levels of salts, chlorides and sulfides are present, staining, and even rust is possible. Examples of these environments are marine coastlines and heavy industrial areas. Railing systems installed in these locations will benefit greatly from regular cleaning and maintenance. AGS has products available to help minimize the build-up of corrosion-causing elements on your railing system, and is happy to discuss how they can be best used for your particular situation.
RETURNS: AUTHORIZATION IS REQUIRED. Stock items may be returned within 30 days of receipt and will be subject to a 15% restocking fee. Returned items must be unused, and in like-new condition, in their original packaging. Custom or powder coated items are NOT eligible for returns. Shipping paid by customer. Refunds will be issued by check unless payment was made by credit card. Credit card refunds will be issued to the card used for payment and will have a 3% processing fee deducted. Please allow 10-14 days for refunds to be issued.
